Parties to social partnership are the state represented by the relevant executive bodies, employees and employers represented by their representatives, authorized in the established manner

Social partnership is ensured in the form of interaction between the parties through the social partnership bodies:

1. at the republican level – by the republican tripartite commission on social partnership and regulation of social and labor relations (hereinafter – the republican commission);
2. at the sectoral level – by sectoral commissions for social partnership and the regulation of social and labor relations (hereinafter – the sectoral commission);
3. at the regional (regionary, city, district) level – by regionary, city, district commissions for social partnership and regulation of social and labor relations (hereinafter – the regional commission);
4. at the level of organizations in the form of collective agreements establishing specific mutual obligations in the sphere of labor between representatives of employees and the employer based on the legislation of the Republic of Kazakhstan.

Permanent functioning republican, sectoral, regional commissions are formed on the basis of the following principles:

1. mandatory participation of representatives of executive authorities, representatives of employers and workers in the activities of commissions;
2. powers of the parties;
3. equal representation;
4. equal rights of the parties;
5. mutual responsibility of the parties.

Social partnership in the Republic of Kazakhstan is aimed at solving the following tasks:

1. The creation of an effective mechanism for regulating social, labor and related economic relations;
2. assistance in ensuring social stability and public accord based on an objective consideration of the interests of all sectors of society;
3. assistance in ensuring guarantees of the rights of employees in the sphere of labor, the implementation of their social protection;
4. facilitating the consultation and negotiation process between the parties to social partnership at all levels;
5. assistance in resolving collective labor disputes;
6. development of proposals for the implementation of state policy in the sphere of social and labor relations.

Collective agreement

The parties to the collective agreement are the employer and employees represented by their representatives authorized in the prescribed manner.

A collective agreement can be concluded both in organizations and in branches and representative offices of foreign legal entities. In organization allowed existence of one collective agreement.

To conduct collective negotiation and prepare a draft collective agreement, the parties create a commission on a parity basis. The number of members of the commission, its personnel staff, the deadline of project development and the conclusion of a collective agreement are determined by agreement of the parties.

The following provisions are included in the collective agreement:

1. on rationing, remuneration systems, the size of tariff rates and salaries, allowances and bonuses to employees, including those engaged in heavy work, work with harmful and (or) hazardous working conditions;
2. on the establishment of inter-category coefficients;
3. on the length of working time and rest time, labor leave;
4. on the creation of healthy and safe working and living conditions, on the amount of financing of measures for safety and labor protection, on improving health protection;
5. on the creation of conditions for the activities of the trade union;
6. on the procedure for amending and supplementing the collective agreement;
7. on the control and responsibility of employees and the employer for the implementation of the collective agreement;
8. on acts of the employer requiring consideration of the opinions of representatives of employees;
9. on the procedure for admission to heavy work, work with harmful and (or) hazardous working conditions for persons who have reached retirement age.
