This Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) is a public Agreement concluded between the owner of the online store, Limited Liability Partnership.Horizon INC“(Seller) and the Buyer in accordance with Article 387 of the Civil Code of the Republic of Kazakhstan, based on the Law of the Republic of Kazakhstan “On Personal Data and Their Protection”, applies to information containing personal data of Buyers, which the online store http://www .horizon–university.kz (hereinafter referred to as the Online Store) can obtain information about Buyers while they are using the Online Store website.
1. Definition of terms
1.1. Personal data – information relating to a specific subject of personal data or determined on their basis, recorded on electronic, paper and (or) other tangible media.
1.2. Non-personal data – information that is automatically transmitted when the Buyer views advertising blocks and when visiting pages on which the system’s statistical script is installed: address of the requested page, cookie information, IP address, browser information, referrer (address of the previous page), access time .
1.3. Collection of personal data – actions aimed at obtaining personal data.
1.4. Processing of personal data – actions aimed at accumulating, storing, changing, supplementing, using, distributing, depersonalizing, blocking and destroying personal data.
1.5. Protection of personal data is a set of measures, including legal, organizational and technical, carried out for the purposes established by the Law of the Republic of Kazakhstan “On Personal Data and Their Protection”.
1.6. Online store – an Internet site located on a server in Almaty and having an Internet address http://www.horizon–university.kz, which presents the goods offered to Buyers for placing Orders, as well as the terms of payment and delivery of these Orders to Buyers.
1.7. Website services – all services available for use on the website http://www.horizon–university.kz and subdomains.
1.8. Buyer – user of the online store.
1.9. Seller – Limited Liability Partnership “Horizon INC», being the owner of the online store, BIN 070340001902.
1.10. Cookies are small text files into which the browser records data from sites visited by Buyers. Cookies perform a number of functions, for example, allowing the Buyer to navigate efficiently between pages, remembering his preferences, and thus improves the experience of interacting with the Internet site. They can also help ensure that the advertising a Buyer sees online is relevant to their interests. If you do not use cookies, then it will not be possible to buy goods in the online store at all, since the entire operation of the shopping cart is based on saving data from these files. For example, if the Buyer selects a product in an online store, puts it in the cart and goes to a new page, then this product simply will not be saved in the cart.
1.11. IP address is a unique network address of a node in a computer network built using the IP protocol, allowing the location of the Buyer to be determined. The online store does not track location, more than city and region.
2. Subject of the privacy policy
2.1. This Privacy Policy establishes the Seller’s obligations to non-disclose and ensure a regime for protecting the confidentiality of personal data that the Buyer provides at the Seller’s request when registering on the online store website and/or when placing an order to purchase goods.
2.2. Personal data permitted for processing under this Privacy Policy is provided by the Buyer by filling out the registration form on the online store website and includes the following information:
2.2.1. surname, first name, patronymic (patronymic – optional) of the Buyer;
2.2.2. Buyer’s contact phone number;
2.2.3. email address (e-mail);
2.2.4. delivery address of the Product.
2.3. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is also subject to secure storage and non-distribution, except for the cases provided for in clause 4.3.2. and clause 4.4. of this Privacy Policy.
3. Purposes of collecting and processing personal data of Buyers
3.1. The Seller collects, processes and stores only those personal data that are necessary for the provision of Services and/or the Buyer’s purchase of Products from the online store catalog.
3.2. The Seller uses the Buyer’s personal data for the purposes of:
3.2.1. identification of the Buyer for placing an order and/or concluding a contract for the sale of goods;
3.2.2. processing and receiving payments from the Buyer;
3.2.3. delivery of goods to the Buyer;
3.2.4. providing the Buyer with effective customer support;
3.2.5. providing the Buyer with personalized Services;
3.2.6. communication with the Buyer, including sending notifications, requests and information regarding the use of the Services, provision of services, as well as processing requests and applications from the Buyer;
3.2.7. improving the quality of the Services, ease of use, developing new Services;
3.2.8. informing the Buyer about ongoing events and promotions;
3.2.9. conducting statistical and other research based on non-personal data, as well as optimizing advertising messages.
3.3. The Seller is not responsible for the information provided by the Buyer on the website in a publicly accessible form.
3.4. The Seller is not responsible for losses that the Buyer may incur as a result of the fact that his login and password become known to a third party.
4. Rights and obligations of the parties
4.1. The buyer is obliged:
4.1.1. provide information about personal data necessary to use the online store;
4.1.2. change or supplement the information provided if incorrect data is discovered when using the online store.
4.2. The buyer has the right:
4.2.1. to access and edit information about personal data at any time through the web interface provided as part of the services.
4.3. The seller is obliged:
4.3.1. use the information received solely for the purposes specified in section 3 of this Privacy Policy;
4.3.2. ensure that confidential information is kept secret, not disclose transferred personal data without the Buyer’s prior written permission, with the exception of transferring data for the purpose of fulfilling the Buyer’s order (courier services, postal organizations, banks, etc.), as well as authorized government bodies of the Republic of Kazakhstan in the manner established by the legislation of the Republic of Kazakhstan;
4.3.3. take precautions to protect the confidentiality of the Buyer’s personal data in accordance with the procedure usually used to protect such information.
4.4. The Seller has the right to provide access to the collection and analysis of non-personal data of Buyers to third parties for the purposes of statistics and optimization of advertising messages. The use of non-personal data by third parties is governed by their own privacy policies, and the Online Store is not responsible for their use.
5. Other conditions
5.1. The Buyer’s use of the online store means his unconditional consent to this Privacy Policy and the terms of processing by the Seller of the Buyer’s personal data.
5.2. In case of disagreement with the terms of the Privacy Policy, the Buyer must stop using the Site or online store.
5.3. This Privacy Policy applies only to the online store website http://www.horizon–university.kz and subdomains. The online store is not responsible for third party sites that the Buyer can access via links available on the online store website.
5.4. The Seller, due to the specifics of the method of obtaining information, does not verify the accuracy of the personal data provided by the Buyer and does not monitor its relevance. However, the Seller assumes that the Buyer provides reliable personal data and keeps this data up to date. The Buyer bears all responsibility, as well as possible consequences, for providing false or irrelevant personal data.
5.5. Disabling cookies may result in the inability to access parts of the online store site that require authorization.
5.6. The online store collects statistics about the IP addresses of its Customers. This information is used to identify and solve technical problems and to monitor the legality of financial payments.
5.7. The current legislation of the Republic of Kazakhstan applies to this Privacy Policy and the relationship between the Buyer and the Seller.
5.8. The Seller reserves the right to unilaterally change this Privacy Policy to further improve the security system in accordance with the current legislation of the Republic of Kazakhstan.
